Your Right to a Good Faith Estimate (Virginia Disclosure)

Under the federal No Surprises Act and Virginia state regulations, you have the right to receive a “Good Faith Estimate” explaining how much your mental health care will cost. State-licensed mental health providers must give clients who don’t have insurance or who are not using insurance an estimate of the expected bills for medical and mental health services, including psychotherapy sessions.

Key Rights Under the Law:

  • You have the right to receive a Good Faith Estimate for the total expected cost of any non-emergency items or services. This includes related costs like regular therapy sessions, intake assessments, or psychological testing.
  • Make sure your therapist gives you a Good Faith Estimate in writing at least 1 business day before your mental health service. You can also ask your provider, and any other provider you choose, for a Good Faith Estimate before you schedule a service.
  • If you receive a bill that is at least $400 more than your Good Faith Estimate, you have the right to dispute the bill.
  • Make sure to save a copy or picture of your Good Faith Estimate.

Questions or Disputes?

If you have questions, need more information about your right to a Good Faith Estimate, or believe you have been wrongly billed, you can contact either the federal help desk or the Virginia state insurance bureau:
